MANJARI NEHRU KAUL, J. (ORAL) Prayer in this petition is for grant of anticipatory bail to the petitioner in FIR No.196 dated 05.03.2018 registered under Sections 406, 420, 467, 468 and 471 IPC at Police Station DLF, Sector 29, Gurugram Vide order dated 13.06.2018, the petitioner had been granted interim anticipatory bail with direction to join investigation and the relevant part of the said order reads as under:- "Counsel for the petitioner has submitted that the petitioner and the complainant were having business dealings. It is further submitted that, in fact, it is a civil dispute, the petitioner is ready to pay the entire amount to the complainant. It is further submitted that the petitioner will hand over a cheque of Rs.1,00,000/- to the Investigating Officer on 30.06.2018 favouring the complainant."

  compliance of order dated 13.06.2018, the petitioner has joined investigation and cooperated with the investigating agency. Learned State counsel, on instructions, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. She on further instructions submits that the petitioner is not required for further investigation much less for his custodial interrogation.

In view of the above, the petition is allowed and interim order dated 13.06.2018, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C. Needless to say, in case the petitioner misuses the concession of bail granted to him, the State would be at liberty to seek cancellation of the bail granted to him.
