Petitioner has filed this second petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.9 dated 22.01.2010 under Sections 420, 120-B, 506 and 182 IPC, registered at Police Station EDivision, Amritsar. Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. As per the FIR, present petitioner took 15 kgs. of gold from the complainant and has cheated the complainant, in connivance with other coaccused. The petitioner has been in custody since 05.05.2018. CRM No.M-52052 of 2018 -2also remained in custody from 09.03.2012 to 27.07.2012. It is argued that earlier petitioner was declared Proclaimed Offender. The offences are triable by Judicial Magistrate. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the disposal of the case. Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal/surety bonds in the sum of `1,00,000/- with two sureties in the like amount each to the satisfaction of the trial Court/Duty Magistrate.
