The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to re-issue him passport.

The petitioner was issued passport on 15.10.2012 which expired on 14.10.2022. An FIR No. 54 dated 08.04.2014, under Section 15 of the NDPS Act came to be registered against the petitioner at Police Station, Sadar Kharar, District SAS Nagar. The petitioner came to be convicted vide judgment dated 09.10.2015 passed by Judge, Special Court, SAS Nagar. The petitioner preferred CRA-S-5150-SB-2015 before this Court. The petitioner was awarded sentence of 10 years. This Court vide order dated 22.08.2017 suspended sentence of the petitioner.

Learned counsel for the petitioner inter alia contends that case of the petitioner is squarely covered by judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 4.

Learned counsel for Union of India, who on advance notice is present in Court, submits that petitioner may be directed to appear before passport authority alongwith requisite documents and the passport authority, thereafter, would pass an appropriate order within six weeks, in accordance with law.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

In the wake of statements of both sides, the petition stands disposed of. The petitioner is directed to appear before passport authority on 13.12.2023.
