The present petition has been filed seeking issuance of appropriate direction to the official respondents to add the offence under Section 109 of BNS, 2023 in case FIR No. 119 dated 27.08.2025, registered under Sections 74, 115(2), 333, 191(1), 190 and 351(1) of BNS, 2023 at Police Station Gidderbaha, District Shri Muktsar Sahib (Annexure P-2). 2.
Learned counsel for the petitioner contended that the accusedManju Goyal, who is the sister in law of the petitioner had hit the petitioner with a steel water bottle on his head with an intention to kill the petitioner. Learned counsel for the petitioner further submits that due to the act of the accused, petitioner got twenty stitches at two places on his head. To substantiate the said averment, learned counsel relies upon the medical report (Annexure P-1), therefore, he prays that the present petition be PARUL 2026.01.28 10:32 I attest to the accuracy and authenticity of this document
CRM-M-53873-2025 allowed and Section 109 BNS be invoked against the accused in the abovementioned FIR. 3.
Per contra, learned State counsel, on instructions from ASI Prabhjot Singh, submits that the injuries were declared to be simple in nature and, therefore, the relevant provisions have already been invoked against the accused.

In light of the above, this Court is of the considered view that no further orders are required to be passed in the present petition. The petitioner shall be at liberty to raise all permissible grounds to challenge and to avail appropriate remedy in accordance with law before the Court of competent jurisdiction. It is further clarified that learned trial Court shall consider the same on its own merits without being influenced by this order. 5.
