The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to re-issue him passport.

The petitioner was issued passport on 23.06.1992 which expired on 22.06.2002. An FIR No. 276 dated 23.06.2000, under Sections 419, 420, 465, 468, 471, 34 of IPC came to be registered against the petitioner at Police Station, Kotwali, District Bathinda. The police during the course of investigation found the petitioner innocent. The petitioner vide application dated 11.08.2017 applied for re-issuance of passport. CWP No.27058 of 2023 -2- 2023:PHHC:153487 petitioner again, vide application dated 01.08.2022, applied for issuance of passport.

Learned counsel for the petitioner submits that petitioner has submitted representation dated 16.08.2023 to the passport authority, however, till date, despite cancellation of aforementioned FIR, the respondents have not issued passport. The case of the petitioner is squarely covered by judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 1391 4.

Learned counsel for Union of India, who on advance notice is present in Court, submits that petitioner may be directed to appear before passport authority alongwith requisite documents and the passport authority, thereafter, would pass an appropriate order within six weeks, in accordance with law.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

In the wake of statements of both sides, the petition stands disposed of. The petitioner is directed to appear before passport authority on 14.12.2023.
