The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.34 dated 5.3.2018 registered for the offences under Sections 420, 407 and 120-B IPC at Police Station Ghagga, District Patiala.

Notice of motion was issued in this case.

Mr. Dhruv Dayal, learned Senior Deputy Advocate General, Punjab has appeared on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. As per the record, the FIR was registered on 5.3.2018 for the HARPAL SINGH PARMAR 2019.05.13 14:17 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-54665 of 2018 [2] offences under Sections 420, 407 and 120-B IPC. It has been brought to my notice by the learned State counsel that the present petitioner has already been declared as proclaimed offender on 21.11.2018 in this case. As per the complainant's version, the truck was owned by the present petitioner and the petitioner was the driver on the truck. Thread was sent on the said truck through Jyoti Bhandari Transporter to Bihar and liquor was also found in the truck and the truck was apprehended by the Police as per prosecution version along with the thread etc. and the thread has not reached at the destination and the complainant is not knowing whereabouts of the threads sent in the truck.

Keeping in view the facts and circumstances of the present case and the fact that the petitioner has already been declared as proclaimed offender and has avoided the process of law, I do not find it a fit case where the petitioner is entitled for the grant of anticipatory bail. Therefore, finding no merit in this petition, the same is dismissed.
