Mr. Ashish Pal Kaushal, Advocate for the petitioner. **** VINOD S. BHARDWAJ, J. (ORAL) Challenge in the present petition is to the order dated 14.05.2022 passed by National Lok Adalat, Mohali, whereby the maintenance petition of the petitioner has been dismissed.
Undisputedly, the settlement was arrived at between the parties in the proceedings under Section 125 of Cr.P.C. The petitioner thereafter moved an application for seeking revival of the proceedings alleging that certain terms and conditions of the settlement have not been honoured by the respondenthusband. I am of the opinion that once the execution of the settlement is not disputed between the parties, the petitioner cannot impugn the order passed by the National Lok Adalat merely on account of non-compliance of certain terms and conditions of the alleged settlement. At best, the same may confer a right to the aggrieved person to institute fresh proceedings by placing reliance upon the terms and conditions of the compromise/settlement.
