Prayer made in the present petition is for setting aside the order whereby the claim of the petitioner for death benefits and family pension accrued on intestate death of Premwati wife of late Krishan in harness, who was working as Safai Karamchari, was declined. 2.

This Court vide order dated 21.05.2024, while noticing the submissions of learned counsel for the petitioners that legal heir certificate had already been submitted, directed respondents to decide the claim during pendency of the present petition and release the benefits including GPF and leave encashment.

Learned State counsel has produced a copy of letter dated 13.08.2024 addressed to the Advocate General by the Director Sports Department, which is taken on record as Mark 'A', the relevant para whereof reads thus:- "It is further submitted that in compliance with the order dated 21.05.2024, this department vide letter dated 24.06.2024 send the said order passed by the Hon'ble High Court to the office of Accountant General, Haryana HAMANT 2024.08.13 18:50 I attest to the accuracy and integrity of this order/judgment

CWP-37030-2019 (A&ER/Audit), Chandigarh. Thereafter, the office of Accountant General, Haryana (A&E/Audit), Chandigarh vide letter 08.08.2024 issued the financial sanction of General Providant Fund (GPF) Rs. 3,77,209/- in favour of the legal heir. The amount of Rs. 3,77,209/- is being deposited in the bank accounts of the legal heirs through the office of Treasury Officer, Panchkula. It is pertinent to mention here that the Leave Encashment for 36 days of Rs. 27114/- has already been deposited in the bank account of the legal heirs."
