***** ARCHANA PURI, J. (Oral) In consonance with the recitals of the reply filed to the transfer application, the counsel for the respondent submits that the respondent still agrees to make payment of one time lump sum amount of Rs.10,000/-, for travelling from Kaithal to Jind.

In view of the said offer, the counsel for the applicant submits that same is acceptable to the applicant, without prejudice to the rights of the parties, to be adjudicated vis-a-vis, the litigation expenses and also, without prejudice to the decision to be rendered, on the basis of the evidence in the petition before the Family Court.

In view of the aforesaid fact situation, the respondent is hereby directed to make payment of Rs.10,000/-, as one time lump sum amount, for the expenses of travelling from Kaithal to Jind, on the next date fixed before the Family Court.

TA-1549-2023 (O&M) However, besides the aforesaid amount, the Family Court shall be at liberty to continue further and pass any appropriate order, with regard to the litigation expenses and decide the petition on merits, on the basis of the evidence coming on record.

In view of the aforesaid, the counsel for the applicant, at this stage, submits that he does not want to pursue with the transfer application and the same be dismissed as withdrawn.
