The petitioner Khushwant Rai @ Goldi, who stands convicted vide judgment and order dated 4.12.2002 passed by learned Additional Sessions Judge (Ad-hoc), Patiala for having committed offences punishable under Sections 302, 307, 376, 201 and 34 of Indian Penal Code, 1860 and has been sentenced to undergo life imprisonment, has approached this Court seeking his pre-mature release.

The learned State counsel has today filed reply by way of affidavit of Sh. Gurcharan Singh Dhaliwal, Superintendent District Jail, Nabha wherein in preliminary submissions No.(viii) it has been stated that the matter pertaining to premature release of the petitioner is pending consideration. That in order to avoid any further legal complication a letter was written by undersigned vide this office letter 2580 dated 30.08.2019 for getting their opinion regarding initiation of premature release case. After getting requisite permissions, premature case of convict/petitioner initiated and sent to office of District Magistrate, Panchkula vide this office letter:3924-26 dated 28.11.2019, which at present is pending in office of District Magistrate Panchkula, for getting verification reports (True translation copy of letter Head No.3924-26 dated 28.11.2019 is annexed herewith as Annexure R-2/T). 3.

Since the matter is stated to be under consideration, this petition is disposed off with a direction to authorities concerned to dispose of the matter pertaining to premature release in accordance with law as per the Policy applicable expeditiously preferably within a period of 2 months from today.
