RAMENDRA JAIN, J. (ORAL) Through instant petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner-Karamjeet Singh @ Kammu, in case FIR No. 229 dated 29.07.2018, registered under Section 21 of the Narcotic Drugs and Pshychotropic Substances Act, 1985 at Police Station Kalawali, District Sirsa.
According to the prosecution, petitioner was apprehended with conscious possession of 8.30 grams of heroin. Learned counsel for the petitioner inter alia contends that FSL report has not yet been received. Therefore, it cannot be said at this stage that alleged recovery was a narcotic substance. Petitioner is in custody since 27.09.2018.
In view of above, but without expressing any opinion on the merits of the case, the petitioner is granted interim bail subject to RISHU KATARIA 2019.01.22 12:30 I attest to the accuracy and integrity of this document
