RAMENDRA JAIN, J. (ORAL) Through instant second petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner in a case arising from FIR No.206 dated 13.09.2016 under Sections 21C, 27A of the Narcotic Drugs and Psychotropic Substances Act, 1985 and Section 18C of the Drugs and Cosmetics Act, 1940 at Police Station Jakhal, District Fatehabad.

According to the prosecution, petitioner was apprehended with conscious possession of 85 bottles of Corex 100 ml cough syrup and 1100 tablets of Carisoma. Earlier bail application of the petitioner was dismissed on 08.08.2017.

Learned counsel for the petitioner inter alia contends that petitioner is not booked in any other case under the NDPS Act. He is in custody since 13.09.2016. Conclusion of trial may take a sufficient long time. On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.

Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail during pendency of trial, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
