The present petition has been filed under Article 226 of the Constitution of India to release the petitioner on 10 weeks' regular parole leave under Section 3 of Haryana Good Conduct Prisoners, (Temporary Release) Act, 2022.

Learned counsel submits that claim of the petitioner for parole was rejected vide order dated 11.09.2025, Annexure P5, on the premise that he has not undergone 5 years, as per the Haryana Good Conduct Prisoners (Temporary Release) Amendment Act, 2014, which came into force w.e.f. 31.03.2014, thereafter the Act was amended as per Haryana Act No.16 of 2015 vide Notification dated 18.09.2015, as per Proviso to Section 2(2), the five year imprisonment shall not include imprisonment during trial period for more than 2 years, thus, he prays that the matter be reconsidered as he has completed more than 3 years after conviction and 2 years during trial. 3.

Learned State counsel, on instructions, submits that the matter shall be reconsidered and decision thereon be taken, in the light of the Notification dated 18.09.2015 and the facts as stated above, within a period of 3 weeks, uninfluenced by the impugned order dated 11.09.2025, Annexure P5, in the present case.

The aforesaid satisfies learned counsel for the petitioner. 5.

Disposed of accordingly.
