The petitioner through instant petition under Article 226 of Constitution of India is seeking setting aside of communication dated 21.10.2023 (Annexure P-8) whereby she has been asked to furnish succession certificate to qualify as legal heir of the deceased employee. 2.
Neeraj Bharaj was enrolled with BSF in September' 2013 as Constable. The petitioner walked down the aisle with Neeraj Bharaj on 13.10.2018 according to Sikh rites and ceremonies. The husband of the petitioner died in harness at Aizawl in the State of Mizoram on 10.09.2023. 3.
Learned counsel for the petitioner submits that the petitioner was issued identity card as dependant of BSF Personnel. A son was born from the wedlock of the petitioner and Neeraj Bharaj. The respondents are wrongly asking the petitioner to submit succession certificate. The petitioner, as per record of the respondents, is legally wedded wife of the ANJU GOEL 2023.12.04 17:51 I attest to the accuracy and integrity of this document

Learned counsel for respondents No.1 to 4, who on advance notice is present in Court, submits that the case of the petitioner would be considered and an appropriate order would be passed within three months from today.
