Prayer in the present petition filed under Articles 226/227 of the Constitution of India is for issuance of writ in the nature of Mandamus for directing the respondents to ensure compliance without any discrimination of the approval granted by respondent No.1/Ministry of Labour and Employment vide letter dated 16.03.2017 (Annexure P-13) and Sanction No. Pension-I/12/33/EPS Amendment/96/Vol.II, dated 23.03.2017, issued by respondent No.2 (Annexure P-14) to all the Regional Provident Fund Commissioners, Regional Offices, Sub Regional Offices for compliance of the order passed by Hon'ble Supreme Court in Civil Appeal Nos.1001310014 of 2016 dated 04.10.2016 (Annexure P-10). Learned counsel for the parties are ad idem that the matter would be covered with the decision given by the Hon'ble Supreme Court in SLP (C) No.8658-8659 of 2019, titled as "EPFO vs. Sunil Kumar B" AIR (2022) SC 5634 as well as the Circular dated 29.12.2022 (Annexure P-35) and the subsequent Circular dated 25.01.2023 (Annexure P-36). 3.

Learned counsel appearing for the respondent-Department submits that the claim of the petitioners will be considered in terms of the aforesaid judgment as well as the aforesaid Circulars Annexure P-35 and Annexure P-36.

In view of the above submission made by respective counsels, the instant petition is disposed of in the aforesaid terms. 5.
