Learned counsel for the petitioner submits that the petitioner has already been retired from service but his pensionary benefits have not been released to him on the ground that a show cause notice was issued to the petitioner for effecting recovery from the petitioner which proceedings are not being finalized yet.

Learned counsel for the petitioner submits that the petitioner will be satisfied, at this stage, in case a direction is issued to the respondents to conclude the proceedings with regard to the disciplinary proceedings which are pending against the petitioner in a time bound manner so that the petitioner does not suffer any prejudice qua the release of his certain pensionary benefits.

On the asking of the Court, Mr. Pankaj Middha, Additional Advocate General, Haryana, who is present in Court, accepts notice on behalf of the respondent-State and submits that an appropriate speaking order with regard to disciplinary proceedings if not already passed after finalizing the disciplinary proceedings initiated against the petitioner will be passed by the RIYA 2023.12.11 17:06 I attest to the accuracy and integrity of this document

CWP No. 27644-2023 (O&M) -22023:PHHC: 157064 competent authority within a period of three months of the receipt of certified copy of this order and after the passing of the order whatever the benefits are to be extended to the petitioner will also be extended to the petitioner within a further period of six weeks. 5.

Learned counsel for the petitioner submits that keeping in view the statement of learned State counsel, the present petition may kindly be disposed of having been not pressed any further. 6.
