**** MANJARI NEHRU KAUL, J. (Oral) The present petition has been filed under Section 438 Cr.P.C., for grant of anticipatory bail to the petitioner, in case FIR No. 108, dated 29.10.2019, under Section 376 IPC, registered at Police Station Chabbewal, District Hosharpur.
Learned counsel for the petitioner submits that on the face of it, false allegations have been levelled against the petitioner as would be evident from the fact that similar allegations were levelled earlier in time against a neighbour. However, the matter was thereafter compromised. It has also been contended that the petitioner, who is the real brother-in-law of the complainant, is a very much married man and living in Doha (Qatar) and returned to India only on 11.03.2019. Learned counsel for the petitioner further submits that pursuant to order dated 18th December, 2019, passed by this Court, the petitioner has joined the investigation. This fact is not disputed by the counsel for the State as well. Learned State counsel on instructions from ASI Kuldeep Singh, states that the petitioner is no longer required for further interrogation. In view of the above, the petition is allowed and interim order dated 18th December, 2019, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.
