 The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents No. 5 and 6 to issue police verification report of the petitioner to respondent No. 2.

The petitioner was issued passport on 02.12.2004 which expired on 01.12.2014. Two FIRs came to be registered against the petitioner. The petitioner vide order dated 30.10.2019 passed by trial court was acquitted in FIR No. 123 dated 24.06.2009, under Sections 379, 411, 420, 467, 468, 471, 473, 474, 120-B of IPC, registered at Police Station, Sector-31, Chandigarh, however, petitioner was convicted in FIR No. 125 dated 25.05.2009 registered at Police Station, Sector-31, Asgar Ali 2023.12.15 08:58 I attest to the accuracy and integrity of this document

   

  Chandigarh. The petitioner was awarded sentence of less than three years, thus, it was suspended by trial court itself. The petitioner preferred CRA-S-2267-SB-2012 before this Court. This Court vide order dated 06.08.2012 extended suspension of sentence granted by trial court. The petitioner lost his passport and vide application dated 05.09.2023, applied for re-issuance. Realizing that petitioner needs to submit earlier passport, the petitioner lodged report dated 06.11.2023 with Police Station, Saanjh Kendra, Makhu, with respect to loss of his passport. 4.

Learned State Counsel does not dispute the afore-stated factual position with respect to above noted FIRs. 5.

Learned counsel for Union of India submits that petitioner may be directed to appear before passport authority alongwith requisite documents, thereafter, the passport authority would do the needful within six weeks.

In the wake of statements of both sides, the petition stands disposed of with a direction to petitioner to appear before the passport authority on 04.01.2024 alongwith requisite documents. On doing so, the passport authority would pass an appropriate order within six weeks from 04.01.2024.
