(Oral) As per the head note and the prayer clause in the present petition, challenge in the present petition is to the order dated 06.01.2024 (Annexure P-6) passed by learned SDJM Balachaur in case FIR No. 107 dated 18.09.2021 registered under Sections 363, 366 IPC at Police Station City Balachaur, District SBS Nagar, vide which the petitioner is stated to have been declared Proclaimed Person and the file has been consigned to record room. Learned counsel for the petitioner prays that accordingly order dated 06.01.2024 declaring the petitioner as Proclaimed Person be set aside and the petitioner be allowed to surrender before the learned trial Court upon furnishing necessary bail/surety bonds.

Learned counsel for the State points out that petitioner has been declared Proclaimed Person vide order dated 06.07.2022 passed by learned SDJM Balachaur. CRM-M-57326-2024 (O&M) -2 - handed over in Court today, which is taken on record. A copy of the same is also supplied to the learned Counsel for the petitioner. It is, now admitted by learned counsel for the petitioner that the petitioner has been declared Proclaimed Person vide order dated 6.7.2022. However, admittedly, there is no challenge to the order dated 06.07.2022 passed by learned SDJM Balachaur, in the present petition. Yet, it is repeatedly prayed that the petitioner may be granted bail and permitted to surrender before the learned trial Court. Heard.

In view of the above undisputed position, the present petition is dismissed with liberty to the petitioner to file afresh with better particulars, however, subject to payment of costs of Rs.5,000/- to be deposited with the Punjab and Haryana High Court Lawyers' Welfare Association Fund, Chandigarh, within a period of four weeks from today.
