( ORAL) The present petition has been filed under Section 482 Cr.P.C. wherein only prayer has been made that in FIR No.42 dated 17.03.2021 registered under Sections 452, 354, 379-B, 323, 148 and 149 IPC at Police Station Sadar Faridkot, District Faridkot, earlier application moved under Section 319 Cr.P.C. for summoning the petitioners namely Rajbinder Singh, Baljit Singh, Major Singh, Dilbagh Singh, Sarbjeet Singh and Kuldeep Singh was dismissed by the trial Court by passing a reasoned order dated 19.11.2022 (Annexure P-7). However, subsequently on the basis of an application moved by respondent No.7-Pargat Singh, the concerned DSP has further initiated the proceedings against the petitioners.

Learned State counsel has informed that representation which was moved by respondent No.7-Pargat Singh for initiating action against the petitioners in the present FIR has been recommended to be closed by the concerned DSP on the fact that the matter is sub judice. Faced with such situation at this stage, learned counsel for the petitioners seeks to withdraw the present case with liberty to challenge any subsequent orders, if any passed against the petitioners. Disposed of accordingly with the aforesaid liberty.
