The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to re-issue him passport.

The petitioner was issued passport on 26.08.2013 which was valid upto 25.08.2023. The petitioner vide application dated 09.08.2023 applied for re-issuance of passport. An FIR No. 98 dated 17.05.2021, under Sections 323, 325, 148, 149 of IPC (Section 498-A of IPC added later on), came to be registered against the petitioner at Police Station Sadar Kapurthala, District Kapurthala. The petitioner vide order dated 11.03.2022 passed by Additional Sessions Judge, Kapurthala, has been granted concession of anticipatory bail.

Learned counsel for the petitioner submits that police till date has not filed report under Section 173 Cr.P.C. The case of the petitioner is sequarely covered by judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 1391

Learned State counsel does not dispute the factual position with respect to abovesaid FIR.

Learned counsel for Union of India submits that petitioner may be directed to appear before the passport authority alongwith requisite documents and the passport authority, thereafter, would pass an appropriate order after considering the afore-stated judgment within six weeks. 6.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

The petitioner is directed to appear before the passport authority on 04.01.2024 alongwith requisite documents. On doing so, the passport authority would pass an appropriate order, in accordance with law, within six weeks from 04.01.2024.

The petition stands disposed of.
