RAJESH BHARDWAJ, J.(ORAL) Petitioners have approached this Court praying for setting aside the orders, dated 20.07.2023, Annexure P-3 and 13.10.2023, Annexure P-29, passed by respondents No.5 and 6 whereby application to restore the water course at MOGA No.111730/L Rajwah Sirsa Major constructed in rectangle No.140 Killa No.5,6,15, 16 and 25 in the area of village Jodhka, Tehsil Nathusari Chopta, District Sirsa which was running since last more than 40 years and the petitioners were getting canal water from Sirsa Major Distributor at Moga No.111730/L to irrigate their agricultural land of about 19 acres was dismissed. It is further prayed that respondents be directed to restore the water course in Khasra No.290, Murban No.140 and Killa No.

5, 6, 15, 16 and 25 villag Jodhka, Tehsil Nathusari Chopta, District Sirsa as all the evidences of the above said water course are available as stated above and the water course is liable to be restored at the earliest as the petitioners are facing acute shortage of water and the petitioners are not getting canal water to irrigate their fields, so as to meet the ends of justice. It is further MEENU 2023.12.

CWP-27301-2023 -22023:PHHC:155040 prayed to direct the respondents to pay compensation to compensate the petitioners as the petitioners has got financial loss due to act and conduct of respondents No.4, 5 and 6 as the crops of the petitioners has been destroyed due to shortage of water since Sauni 2020 to till date of 19 acres of land belong to the petitioners is not being irrigated due to act and conduct of respondents No.4, 5 and 6.

Learned counsel for the petitioners prays for withdrawal of the present petition with liberty to the petitioners to avail their alternative remedy as available to them under law.

Allowed as prayed for.
