26 Present writ petition has been filed for quashing the notices dated 14.11.2023 and 23.11.2023 (Annexures P-3 and P-4) for Dakhal proceedings issued during the pendency of revision before the Commissioner against order dated 19.09.2023 and appeal pending before Collector Hodal against order dated 05.10.2023 during the pendency of the revision for partition proceedings. Further prayer has been made for directing the official respondents to stay the proceedings of Dakhal before Assistant Collector during the pendency of revision and appeal pending before the higher authorities.

Learned counsel for the petitioner has submitted before this Court that the petitioner has already filed the revision petition along RITTU 2023.12.22 16:16 I attest to the accuracy and integrity of this document

He submits that during the pendency of the same, the respondents authorities are proceeding to take the possession. Learned counsel appearing on behalf of respondents No.5 to 7 has informed the Court that the revision filed by the petitioner is pending before the Commissioner for 15.02.2024. He submits that because of the pendency of the petition, they are not proceeding further to await the decision of the stay application filed by the petitioner. In view of the above position, the present petition is disposed of with direction to respondent No.2-the Commissioner, Faridabad to decide the stay application filed by the petitioner along with the revision petition on the date fixed i.e. 15.02.2024 after hearing both the sides in accordance with law.
