This petition has been filed seeking a writ of mandamus directing the respondents to grant social security benefit i.e. (EPF/NPS, Medical Allowance, LTC and Insurance etc.) and dearness allowance (DA) to the petitioner from the date of his appointment, in view of the law laid down by the Supreme Court in Civil Appeal No.353 of 2020 titled M/s Pawan Hans Limited and others v. Aviation Karamchari Sanganthan and others and State of Punjab and others v. Jagjit Singh and others, 2017 (1) SCC 148.

Learned counsel for the petitioner submits that grievance raised herein is pending for appropriate decision before the respondents. At this stage, the petitioner will be satisfied in case the respondents are directed to decide the pending representation dated 7.7.2023 (Annexure P-8) of the petitioner in a specified period.

In view thereof, without going into the merits of the case, the petition is disposed of with a direction to respondent no.2/Director BPS Government Medical College, to consider and decide the petitioner's pending representation dated 7.7.2023, by passing a speaking order thereupon in accordance with law, within a period of two months from the date of receiving a certified copy of this order. In case the petitioner is found entitled the benefits claimed, the same shall be released to him within a period of six weeks therefrom.
