(ORAL) Through instant Criminal Writ Petition under Articles 226/227 of the Constitution of India, prayer has been made for issuance of writ in the nature of Habeas Corpus to respondents No.1 to 3 to search, recover detenue respondent No.7, son of the petitioner, allegedly in custody of respondents No.4 to 6.

Producing photocopy of FIR No.0399 dated 22.10.2019 registered under Sections 364, 506 IPC at Police Station Hyatnagar, District Sambhal, learned State counsel pointed out that petitioner levelled allegations of demanding `5.00 lakh by respondents No.4 to 6 from the petitioner to handover custody of her missing son, whereas there is no such allegation in FIR No.118 dated 17.04.2019 registered under Section 346 IPC at Police Station Kheri Pul, District Faridabad, nor in the instant petition. Therefore, this petition, being in the nature of habeas corpus, has rendered infructuous. In view of above, learned counsel for the petitioner prays that he may be permitted to withdraw this petition with liberty to take appropriate recourse before the Area Magistrate.
