*** NIDHI GUPTA, J. (ORAL) Prayer in the present criminal writ petition under Article 226 of the Constitution of India is for issuance of a Writ in the nature of Mandamus for directing respondents No.2 to 5 to protect the life and personal liberty of the petitioner from the hands of respondent No.6 to 12 by providing adequate security/police protection to the petitioner and also for issuing necessary directions to the respondent No. 2 to 5 to investigate the FIR No.156 dated 09.07.2024 (Annexure P-2) registered under Sections 323, 354, 506, IPC and Section 3(1)(R), 3(1)(S) SC/ST Act registered at P.S. Jagadhri Sadar, District Yamuna Nagar in a lawful manner and to fairly investigate the matter in impartial manner by some independent investigating agency and also to consider representations of petitioner while investigating present FIR and to bring the investigation of the case to logical end.

Learned counsel for the petitioner inter alia submits that

CRWP-10963-2024 (O&M) -2 - private respondents No.6 to 12 herein are continuously threatening and abusing the petitioner and his family with casteist words. It is contended that on 28.06.2024, respondent No.6 had started abusing the family of the petitioner/complainant by using casteist words. It is further alleged that respondents No. 7 to 12 had first broken the wall and tower of the house of the petitioner by pushing and then thrashed wife, parents and son of the petitioner. Respondents No. 8 and 9 are alleged to have torn clothes of the petitioner and touched private parts of the petitioner to outrage his modesty. Learned counsel for the petitioner submits that accordingly, a representation dated 28.06.

2024 (Annexure P-1) was duly made by the petitioner to the Superintendent of Police, District Yamuna Nagar, in pursuance of which, present FIR (Annexure P-2) was registered against the accused persons. It is, however, contended that no action has been taken by the police authorities in pursuance of registration of FIR. Learned counsel for the State, on instructions from SI Om Parkash, informs this Court that investigation was conducted in the present FIR upon which 3 accused persons being respondents No. 7, 9 and 11 were found to be innocent and challan was prepared against the remaining respondents i.e. respondents No. 6, 8, 10 and 12, which is likely to be submitted soon.

It is also noticed that it has been alleged by the petitioner that he and his family members were thrashed by the accused persons, however, no MLR in respect of the same has been attached. In view of the facts as noticed above, no further directions are required to be issued in the present matter. The present petition stands disposed of.
