The petitioner seeks grant of anticipatory bail in respect of the aforementioned FIR.

The FIR was lodged at the instance of Kashmir Singh, wherein it is alleged that the petitioner and other co-accused, who all are brothers, while professing themselves to be owners entered into an agreement with the complainant for purchase of land, whereas they were not owners and a civil suit with respect to the title of land was already pending. 3.

It has further been submitted that the petitioner, in any case, has already joined investigation and since the other co-accused i.e. real brothers of the petitioner, who were identically situated namely Satvinder Singh and Harjinder Singh have already been extended the benefit of anticipatory bail, the petitioner also deserves the same concession on grounds of parity. 4.
Vide order dated 7.12.2023, this Court while issuing notice of motion had released the petitioner on interim bail while directing him to join investigation.

Learned State counsel, upon instructions from ASI Jaswinder Pal, has informed that pursuant to interim directions, the petitioner has joined investigation and is not required for any custodial interrogation and that he is not involved in any other case.

Having regard to the aforestated position, wherein the petitioner is stated to have joined investigation and is not required for any custodial interrogation, the petition is accepted and the interim directions issued by this Court vide order dated 7.12.2023 are hereby made absolute, subject to the condition that the petitioner shall join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438(2) Cr.P.C.
