1. The petitioner has filed this writ petition claiming that he should be appointed in a department other than the department allotted to him namely the Directorate of Medical Research and Education by the Punjab Subordinate Services Selection Board.
2. Learned counsel for the petitioner submits that the petitioner was asked to submit his preference list relating to the various departments, and the department allotted to him was twelfth in his choice of departments. It is stated that the departments mentioned in his choice from serial no.1 to 11 could have been allotted to him as there would be cases of non-joining of higher meritorious persons, and the said post therefore ought not be offered to persons lesser in merit to the petitioner, after the petitioner has joined.
3. Learned counsel submits that the petitioner should be given a second chance for option, if the posts in the departments are not filled by higher meritorious persons. He submits that the petitioner had also submitted a representation to the Punjab Subordinate Services Selection Board and had also sought NOC from the office of Director, Medical Research and MOHIT GOYAL 2023.12.04 17:20 I attest to the accuracy and integrity of this document
CWP-27192-2023 2023:PHHC:154122 Education. An application was also moved under RTI seeking information about the merit of the candidates who have been posted in the other departments.
4. I have considered the submissions.
5. It is noticed that the petitioner after having opted at Directorate of Medical Research and Education as twelfth option amongst the total number of 65 options given by him, as per his merit, he was allocated the department. It seems that he was unhappy to be posted in the said department as the stations for joining available for the petitioner were Amritsar, Mohali and Patiala alone which as per him were quite away from his hometown. He therefore submitted a representation seeking no objection and allowing him some other department. The said representation was rejected by the Punjab Subordinate Services Selection Board vide its letter dated 28.04.2023. The petitioner has thereafter joined on 02.08.2023 and has preferred this writ petition praying for shifting of his department.
6. This Court finds that even under the RTI, he was informed that the allotment of departments to candidates has been done as per the instructions issued on 15.03.2019. The petitioner has not been able to show any person having lesser merit been allotted any of the departments opted by him from serial no.1 to 11.
7. In view thereof, no relief can be granted to the petitioner.
