Dated Police Station Sections 18.10.2005 Anti Corruption Bureau, Hisar 13(1)(d) r/w 13(2) of PC Act 1988 and Sections 420, 467, 468, 471, 120B IPC Seeking quashing of the above said FIR (P-2), subsequent charge sheet dated 05.07.2023 and also the summoning order dated 07.07.2023 (P-9), petitioner has come up before this Court by filing the present petition under Section 482 CrPC.

After arguing for some time, petitioner's counsel seeks permission to withdraw the present petition with two liberties. Firstly to make a representation regarding his innocence to any superior officer if so advised. Secondly, that petitioner is running a coaching institute and in case he frequently remains absent himself, it would squarely impact the studies and quality of education of the students, as such till framing of charges he be permitted to appear through counsel.

State has no objection if both the prayers are accepted. 4.
Given above, petition is disposed of as withdrawn with liberty to petitioner to file representation before the concerned Superior officer, if he so advised and he is also permitted to appear through his counsel before the trial Court, till final decision is taken on framing of charges, subject to the condition ANJU RANI 2023.12.07 10:35 I attest to the accuracy and integrity of this document
CRM-M-61079-2023 2023:PHHC:155580 that his counsel shall appear on his behalf on every date. It is clarified that in case, counsel fails to appear before the trial Court on the date fixed, petitioner has to appear personally and this order qua extent of appearance through counsel, shall stand recalled without any further reference to this Court, under Section 362 read with 482 CrPC. It is further clarified that in case, trial Court asks for petitioner's appearance in person by passing specific order, he shall appear on the date as fixed by trial Court.
