SUVIR SEHGAL J. (Oral) Learned counsel for the petitioner has submitted that the petitioner was suspended from the post of Sarpanch, vide order dated 30.10.2019 (Annexure P-3). She challenged the said order by filing an appeal dated 25.11.2019 (Annexure P-4). Alongwith an appeal, she had filed an application for stay of operation of the suspension order. Learned counsel has further submitted that the appeal came up for hearing before the appellate authority on 05.12.2019. After hearing the petitioner, appellate authority, issued notice and called for the record for 23.01.2020. His grievance is that application for stay which had been filed with the appeal was not decided.

He has also submitted that in the meantime, notice (Annexure P-6) has been issued by the Block Development and Panchayat Officer, Block Guruhar Sahai, District Ferozepur (respondent No.4) for election of authorized Panch. Keeping in view the fact that the appeal as well as application for stay filed by the petitioner is pending before the appellate authority, it is a fit case where direction deserves to be issued to the appellate authority to decide the application for stay within a period of two weeks from today after issuing notice and hearing the petitioner. Till the time the stay application is not disposed of by the appellate authority, holding of meeting in pursuance to notice (Annexure P-6) shall remain stayed. The writ petition is accordingly disposed of.
