JASJIT SINGH BEDI, J. (Oral) The prayer in the present petition under Section 482 Cr.P.C. is for quashing of the orders dated 04.07.2023 and 16.08.2023 (Annexures P.2 and P.3) passed by the Additional Sessions Judge, Gurugram in case bearing No. SC-799-2021 titled as 'State Versus Ajab and others" registered on 03.12.2021 arising out of FIR No.180 dated 08.09.2021 under Sections 147, 148, 149, 307, 325 and 506 IPC at Police Station Sector 65, Gurugram (Annexure P-1) whereby the bail bonds of the petitioners were forfeited to the State.
On 04.12.2023, the following order was passed :- "The prayer in the present petition under Section 482 Cr.PC is for quashing of the orders dated
- 2 - 04.07.2023 and 16.08.2023 (Annexures P-2 and P-3) passed by the Additional Sessions Judge, Gurgram in case bearing No."SC-799-2021 titled as State versus Ajab and others" registered on 03.12.2021 arising out of FIR No.180 dated 08.09.2021 under Sections 147, 148, 149, 307, 325 and 506 IPC at Police Station Sector 65, Gurugram (Annexure P-1) whereby the bail bonds of the petitioners were forfeited to the State. The learned counsel for the petitioners contends that the petitioners had moved an application for exemption which came to be declined, pursuant to which impugned orders came to be passed. He states that the petitioners are ready and willing to join the proceedings once again.
Notice of motion for 30.01.2024.
In the meanwhile, the petitioners are directed to surrender before the Trial Court within a period of one week from today and subject to a deposit of Rs.25,000/- each as costs with the Association for Children with Type 1 Diabetes, SCO 24, Sector 23-C, Chandigarh, they shall shall be admitted to interim bail to the satisfaction of the trial Court.
The learned counsel for the petitioners shall produce the receipts regarding deposit of Rs.25,000/- each with the aforesaid Association and well as copies of the orders granting interim bail to both the petitioners on the next date of hearing."
- 3 - In deference of the aforementioned order, the petitioners have been released on interim bail vide order dated 12.12.2023 passed by the Additional Sessions Judge, Gurugram, which is taken on record as Mark 'A'.
In view of the above, no further orders are required to be passed by this Court.
Disposed of.
It is expected that the petitioner shall not absent himself from the Trial without sufficient cause.
