The entire case setup by the petitioner is based upon the RTI information received relating to the number of votes with reference to the abadi of the 15 wards, which have undergone delimitation. 2.

The information was given on 15.12.2023 by the PIO, wherein, it is stated that so far as the discrepancy of the number of votes viz-a-viz the abadi of the Ward No.13 and 14 is concerned, the same is being inquired into and was based on the voter list of the Vidhan Sabha of that area. Such information having been received, wherein, inquiry is yet to be completed, cannot be basis for challenging of delimitation process and praying for the fresh delimitation.

We are of the firm view that the citizen right is only limited to see whether the respondents allow the concerned citizen to participate in the voting, and not with regard to how the delimitation is done. The JAWALA RAM 2024.11.13 20:09 I attest to the accuracy and authenticity of this document

CWP-30369-2024 - 2 - delimitation is being done in accordance with the Delimitation of Wards of Municipalities Rules, 1972. Thus, no case for violation is made out.
