(Oral) At this stage, counsel for the respondent submits that he does not want to file reply and has no objection if the transfer application is partly allowed and the petition under Section 9 of Hindu Marriage Act, is transferred from Kurukshetra to the courts at Derabassi, as the applicant resides in Dhakoli, which is part of Derabassi. In view of the submissions made by the counsel for the respondent, counsel for the applicant also submits that he has no objection if the petition under Section 9 of Hindu Marriage Act, stands transferred to the courts at Derabassi.

Even though, the application at first instance was filed at the instance of the applicant, for seeking transfer from Kurukshetra to the courts of competent jurisdiction at Panchkula, where she is working as Tax Assistant with the Income Tax department, but however, she is resident of Sonu 2025.04.30 16:06 I agree to specified portions of this document P&HHC

TA-1442-2024 Dhakoli, Zirakpur, which falls within the jurisdiction of Derabassi courts. In view of the submissions made by the respective counsel, as recorded aforesaid and also considering the fact that the applicant is a resident of Dhakoli, Zirakpur, the transfer application is partly allowed and the petition under Section 9 of the Hindu Marriage Act i.e. HMA/209/2024, titled 'Shiv Kumar v/s Monika Dahiya', filed by the respondent-husband, stands transferred from the Family Court, Kurukshetra to the Family Court (Camp Court), Derabassi, District SAS Nagar. The requisite record of the aforesaid case be sent by the Family Court, Kurukshetra to the District and Sessions Judge, SAS Nagar.

Learned District and Sessions Judge, SAS Nagar, shall assign the said petition to the Family Court (Camp Court) Derabassi. Even, the parties are directed to appear before the Family Court (Camp Court) Derabassi, within a period of one month from today onwards.
