(ORAL) Learned counsel for the petitioner argues that though the claim of the petitioner for the grant of increment and the grade pay is covered by a decision of this Court rendered in CWP No.3922 of 2011 titled as 'Narender Pal Singh Arya and another Vs. State of Haryana and others', decided on 03.10.2016, but she has not been given the benefit of the said judgment so far.

Learned counsel for the petitioner further argues that respondent-State has already issued the instructions dated 15.03.2018 (Annexure P-7) for the implementation of the order passed in CWP No.3922 of 2011, but despite the fact that more than 11⁄2 years has elapsed since the issuance of the said instructions, the benefit has not been extended to the petitioner. The prayer of the petitioner is for granting her the benefits under the instructions dated 15.03.2018 (Annexure P-7). CWP-37044-2019 -2Counsel for the petitioner states that for the relief, which is being claimed by the petitioner in the present writ petition, the petitioner has served the respondents with legal notice dated 08.01.2019 (Annexure P-8), which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to respondent No.2 to decide the said legal notice. In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, respondent No.2 is directed to decide the legal notice dated 08.01.2019 (Annexure P-8) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. Present writ petition stands disposed of.
