**** Manjari Nehru Kaul, J.(Oral) Instant petition has been filed under Section 438 Cr.PC for grant of anticipatory bail to the petitioner in case FIR No.186 dated 09.10.2023 under Sections 384, 506, 420 and 120-B IPC registered at Police Station Salem Tabri District Ludhiana.

Learned counsel for the petitioner inter alia contends that he has been falsely implicated in the instant case along with other accused for allegedly extorting gold ornaments and cash from the daughter of the complainant, after making an obscene video of hers, and subsequently blackmailing her. Learned counsel has submitted that his false implication in the case in hand finds credence from the fact that the allegations levelled in the FIR in question are not only vague but highly improbable, without there being any supportive evidence in the said regard. It has also been submitted that even otherwise as per the allegations levelled in the FIR itself, the occurrence in question happened almost SONIA BURA 2023.12.07 10:58 I attest to the accuracy and integrity of this document
CRM-M-60734-2023 -22023:PHHC:154895 two years back, therefore it was unbelievable that a prudent person would not come to know about her gold ornaments having gone missing for such a long period of time. Learned counsel has still further submitted that the custodial interrogation of the petitioner would not be necessitated as no recovery is to be effected from him.

Heard learned counsel and perused the relevant material on record.

Prime facie there are serious allegations against the petitioner of not only having committed theft and played a fraud but the petitioner allegedly prepared an obscene video of the minor daughter of the complainant, and subsequently, extorted her to commit theft from her own house and hand over cash and gold ornaments to them else her obscene video would be made viral. 5.
In view of the serious allegations levelled against the petitioner, this Court does not deem it fit to extend the extra-ordinary concession of anticipatory bail to the petitioner. Accordingly, the present petition stands dismissed.

However, it is made clear that anything observed hereinabove shall not be construed to be an expression of opinion on the merits of the case.
