HARINDER SINGH SIDHU, J Petitioners have filed this petition under Section 482 Cr.P.C. for quashing of FIR No.168 dated 21.04.2015 under Sections 279,337,338 IPC registered at P.S Bhuna, District Fatehabad as also judgment/order of sentence dated 10.01.2019 and all other consequential proceedings arising out of the said FIR, as the matter stands amicably settled in terms of compromise deed.
It stands noticed that the petitioner was convicted under Sections 279,337,338 IPC and sentenced to undergo RI for six months and to pay fine of Rs.1000/- vide judgment/order of sentence dated 10.01.2019 passed by learned JMIC, Fatehabad. Feeling aggrieved, he preferred an appeal, which is still pending before the court of learned Addl. Sessions Judge, Fatehabad.
Vide order dated 19.12.2019, the parties were directed to appear before the trial Court/Illaqa Magistrate on 24.01.2020 for getting their statements recorded with regard to the compromise and the learned Magistrate was directed to send a report about the genuineness and veracity of the compromise.

CRM-M-54639 of 2019 #2# A report dated 10.05.2022 of learned JMIC, Fatehabad has been received. As per the report, the parties had appeared before learned Magistrate and got recorded their statements regarding compromise. Learned Magistrate has stated that she is of the considered view that the compromise between the parties is valid, genuine, voluntary and without any coercion or undue influence.
Accordingly, the present petition is allowed. FIR No.168 dated 21.04.2015 under Sections 279,337,338 IPC registered at P.S Bhuna, District Fatehabad along with all subsequent proceedings arising therefrom including judgment/order of sentence dated 10.01.2019, are hereby quashed/set aside qua the petitioner.
