The prayer in the present petition under Section 483 of BNSS, 2023 is for grant of regular bail to the petitioner in case FIR No.50 dated 09.03.2023 (wrongly mentioned the date of FIR in impugned judgment (Annexure P-2) as 09.04.2023) under Sections 302, 148, 149 and 201 of IPC, registered at Police Station Division No.8, Jalandhar. 2.

The counsel for the petitioner contends that the petitioner has been falsely implicated in the present case. The evidence recorded against the convicted accused does not inculpate the petitioner. Therefore, he is entitled to the concession of bail.

The counsel for the State contends that the petitioner was arrested long after the occurrence and the co-accused stand convicted. Therefore, he is not entitled to the concession of bail. KUSUM 2026.03.13 16:22 I attest to the accuracy and integrity of this document PHHC Chandigarh 4.

I have heard learned counsel for the parties.

In the instant case, two of the accused already stand convicted by the Court of competent jurisdiction vide judgment dated 25.03.2025. The petitioner was arrested later, after two years of the occurrence. There is every possibility that he would abscond from justice if he is granted the concession of regular bail. Therefore I do not deem it appropriate to grant the concession of bail to the petitioner, at this stage. 6.

In view of the above, I find no merit in the present case and the same stands dismissed.
