Present petition has been filed by the petitioner under Section 528 of BNSS for quashing of the impugned order dated 01.11.2022 passed in FIR bearing No.140 dated 14.06.2018 registered under Section 379 of IPC at Police Station Ambala Sadar, District Ambala (Annexure P-1), vide which, bail of the petitioner has been cancelled.

Mr. Mayank Mahla, Advocate has put in appearance on behalf of respondent No.2 and has filed power of attorney, which is taken on record. 3.

Learned counsel for the petitioner submitted that the petitioner is ready to surrender himself before the learned trial Court and prays that the petitioner be not arrested by the police.

Petitioner is directed to surrender himself before the learned trial Court within 2 weeks i.e. up to 13.10.2025 and to move an appropriate application by raising all the pleas taken in this petition, before the trial Court regarding his non-appearance. The trial Court is directed to decide his bail application in accordance with law. Till then, he will not be arrested by the police in this matter. It is made clear that if he fails to appear before the trial Court within stipulated time then the relief granted by this Court shall be deemed to be withdrawn.

Petition is accordingly disposed of.
