 The allegation against the petitioner is that he alongwith other co-accused injected drugs to the deceased, who was 19 years old and accordingly he was arrested for commission of offences punishable under Sections 304 of the Indian Penal Code and 21/21-B and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 in FIR No. 29 dated 13.02.2023 registered at Police Station Phillaur, District Jalandhar Rural. 2.

The petitioner is in custody since 16.02.2023 and in the trial, charges have been framed against the accused persons on 24.09.2024 and the case is now fixed for recording the statements of the prosecution witnesses. 3.

Considering the gravity of the offence, it would be appropriate that main witnesses are allowed to be examined before the request for grant of bail to the petitioner is considered.
