This is the second petition filed under Section 528 of BNSS, 2023 for the issuance of directions upon the official respondents concerned to conduct a fair and impartial investigation into FIR No. 0137 dated 13.11.2024, registered under Sections 351(3), 87 of BNS, 2023, and Section 6 of the POCSO Act, at Women Police Station Ballabhgarh, District Faridabad.

Status report by way of affidavit of Assistant Commissioner of Police, Tigaon, Faridabad has been filed by the State, which is taken on record. A copy thereof has been furnished to the learned counsel for the petitioner.

In the above status report, it has been stated that during investigation, it was found that the victim had earlier got registered an FIR No. 30 dated 29.3.2022 under Sections 376, 506 IPC and Section 4 of the POCSO Act, at Women Police Station Palwal, and the accused concerned in the said FIR have been acquitted on 31.10.2023. CRM-M-55514-2025 -2FIR. However, no incriminating evidence has been found against accused Fardeen. Accordingly, a cancellation report has been prepared and submitted before the learned Illaqa Magistrate, Faridabad on 14.7.2025. 4.

In view of the above, learned counsel for the petitioner seeks leave to withdraw the instant petition.
