*** DEEPAK GUPTA, J. (ORAL) [1] By way of present petition filed under Section 438 Cr.P.C., prayer is made for grant of anticipatory bail in case FIR No.153 dated 22.07.2023, under Sections 304 and 34 of IPC, registered at Police Station Sultanpur Lodhi, District Kapurthala.

[2] On 16.12.2023, the following order was passed by this Court:- " Present:

**** Short reply by way of an affidavit of Shri Babandeep Singh, PPS Deputy Superintendent of Police, Sub Division Sultanpur Lodhi, District Kapurthala has been filed on behalf of respondent- State. It is informed by learned State counsel that though the postmortem report has been received but cause of death has not been given so far. It has been deferred till the receipt of the chemical examiner report related to viscera.

Adjourned to 20.02.2024 for filing final cause of death of deceased- Jagjit Singh.

2024:PHHC:023133 CRM-M-61060-2023 -2- [3] Today, learned State Counsel, on instructions from ASI Joginder Singh, has informed this Court that though viscera report is still awaited but the petitioner has joined the investigation, in compliance of the order dated 16.12.2023 and is no longer required for further investigation.

[4] In view of the aforesaid, the order dated 16.12.2023, whereby arrest of the petitioner was stayed, is hereby made absolute. It is directed that in the event of arrest of the petitioner, the petitioner shall be released on bail subject to the satisfaction of the Arresting Officer/Investigating Officer. However, it is directed that the petitioner shall not contact any person associated with the case to influence him during trial in any manner whatsoever, nor shall leave the country without prior permission of the Court. He shall further comply with the conditions stipulated in Section 438(2) Cr.P.C.
