ARVIND SINGH SANGWAN, J. (Oral) This is the first petition filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in FIR No. No.79 dated 18.8.2019 under Sections 148, 149, 323, 326, 427 and 506 IPC, registered at Police Station Sector 29, Panipat, District Panipat.

Counsel for the petitioner submits that the petitioner is in custody for the last 03 months and 08 days. The investigation of the case is complete and the challan stands presented. It will take some time in conclusion of the trial. Counsel for the petitioner further submits that the petitioner is not involved in any other case.

Learned State counsel, on instructions form ASI Jagminder has, however, submitted that since one of the victim Ram Mehar has lost his vision of one eye, the SATISH KUMAR 2020.01.10 16:39 I attest to the accuracy and integrity of this document

CRM-M-54817 of 2019 -2petitioner be directed to pay some compensation to him. Without commenting anything on the merits of the case, considering the aforesaid submission made by counsel for the parties and also in view of the fact; the petitioner is in custody for more than 03 months; the investigation of the case is complete and the offence is triable by the Court of Magistrate; this petition is allowed and the petitioner is directed to be released on regular bail, subject to his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate/Illaqa Magistrate, concerned.

This will, however, be subject to deposit of an amount of Rs.40,000/- as cost of medical expenses borne by Ram Mehar to be paid to victim-Ram Mehar before the Illaqua Magistrate at the time of furnishing the bail/surety bonds. The payment shall be without any prejudice to the right of the petitioner to project his defence.
