This is second petition filed u/s 528 of BNSS, 2023, for quashing of FIR No. 335, dated 16.10.2023, u/s 419, 420, 467, 468, 471, 506, 120-B of IPC (Sections 419, 467, 468 and 471 of IPC deleted later on & Section 406 of IPC added later on), registered at P.S. HSIIDC Barhi, Tehsil Ganaur, District Sonipat (Annexure P-1), and challan dated 14.06.2025, qua the petitioner.

As a first attempt, petitioner had filed quashing petition, i.e., CRM-M-10502-2025, claiming similar relief and same was disposed of as not pressed at that stage, vide order dated 25.02.2025 (P-10). 3.
Counsel for the petitioner argues that by recalling its order dated learned Magistrate has once again directed the Investigating Agency to conduct further investigation, however, proceedings in regard to the further investigation are still going on and thus, it has not been finalized so far. 4.
This Court reminds itself that there was another petition filed by the petitioner, i.e., CRM-M-12984-2025, wherein, petitioner has sought JAWALA RAM 2026.01.15 18:56 I attest to the accuracy and authenticity of this document
CRM-M-55399-2025 - 2 - quashing of order dated 01.03.2025, passed by learned JMIC, Ganaur, District Sonipat, whereby, learned JMIC, has reviewed/rectified his own earlier order dated 20.02.2025. However, same was dismissed by this Court by passing a detailed order dated 22.04.2025. Said order has not been appended along with present petition, nor the factum of filing of the petition, i.e., CRM-M-12984-2025, has been detailed therein in the present petition. Such a conduct of the petitioner is not appreciable. 5.
Faced with the situation, counsel for the petitioner prays for withdrawal of present petition with liberty to file a fresh one, if any, cause of action accrues to him.

Dismissed as withdrawn with liberty, as sought and recorded here-above.
