*** Punam Devi (petitioner No. 1) and Jonny Kumar (petitioner No. 2), after performing the marriage on 30.11.2018, had filed one protection petition vide CRM-M-53196-2018 and same was disposed of by the then Co-ordinate Bench of this Court vide order dated 01.12.2018. While disposing of the said petition, official respondent(s) were directed to examine the representation of the petitioners and to grant necessary protection while appreciating the fact of threat to their lives. However, petitioner No. 2 (Jonny Kumar) gave assurance and thus, he was directed for depositing of Rs. 2,00,000/- in the shape of FDR for a period of three years within a period of one month in favour of Punam Devi (petitioner No. 1).

Thereafter, none of the petitioners or any other party to the main petition has approached this Court complaining about non depositing of FDR amount by petitioner No. 2 as directed by this Court. Otherwise also, after disposal of the main petition, matter is being listed again and again for getting compliance of order dated 01.12.2018 i.e. of depositing of sum of Rs. 2,00,000/- in the name of petitioner No. 1 (Punam Devi) in the shape of FDR for a period of three years.

IOIN-CRM-M-53196-2018 in CRM-M-53196-2018 -2Perusal of the file also reveals that after disposal of the main petition on 01.12.2018, matter is being listed only to acknowledge the compliance of deposit of ordered amount in the shape of F. D. R. , however, matter is adjourned time and again by the order of Court Secretary. When the matter was listed on 13.02.2019, there was no representation from the side of petitioners and same was adjourned for 20.03.2019. Thus, again and again matter is being listed for the same purpose.

In view of the such circumstances, I feel that unless there is a complaint or demand by the concerned person (party to the lis) for not making payment of Rs. 2,00,000/- as per order dated 01.12.2018, there is no purpose in keeping the petition pending for indefinite period. Therefore, present IOIN is disposed of at this stage, subject to the moving of an application for revival of the same at the instance of petitioner No. 1 (Punam Devi), if she so desires, within six months from today. IOIN-CRM-M-53196-2018 stands disposed of.
