Prayer in this writ petition filed under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of certiorari, for quashing the entry dated 08.07.2025 and any consequential entries vide which the petitioner was shown as 'relieved' from service. Further a writ of mandamus has been sought, directing respondents No.2 to 4 to reinstate the petitioner forthwith in the same post i.e. Assistant Lineman (ALM) with full continuity of service and seniority as if he had not been relieved and to restore all service records accordingly. Further prayer has been made to direct the respondents to grant the petitioner back wages/monetary benefits payable to the petitioner from 08.07.2025 till the date of actual reinstatement together with all consequential benefits (dearness allowance, increments, leave salary, PF/insurance contributions as applicable, promotion/seniority benefits, etc.) and interest thereon.

Learned counsel for the petitioner submits that he would be satisfied if the representation dated 28.07.2025 (Annexure P-10) of the petitioner is decided by respondent No.3 by passing a speaking order in a time bound manner.

Learned State counsel as well as learned counsel for respondents No.2 to 4, appearing on advance notice, submits that they have no objection, in case a direction is issued to the respondent No.3 for time-bound consideration and decision of the representation dated 28.07.2025 (Annexure P-10) of the petitioner by passing a speaking order.

Therefore, in view of the limited prayer made by learned counsel for the petitioner, respondent No.3 is directed to consider the representation dated 28.07.2025 (Annexure P-10) of the petitioner and pass a speaking order, after affording an opportunity of hearing to the petitioner, within a period of 03 months from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioner. Needless to say, if the petitioner is found entitled to the relief sought, the same shall be granted forthwith by respondent No.3.
