This petition has been filed, inter alia, seeking a writ of certiorari quashing the memorandum alongwith statement of allegations and statement of charges dated 13.11.2023, Annexure P-3. Further, a writ of mandamus has been sought directing the respondents to withdraw the same in the interests of justice.

Learned counsel for the petitioner contends that the memorandum/charge-sheet, dated 13.11.2023, has been issued on false allegation that while the petitioner was holding charge of school Principal, written statement in case, CWP No.626 of 2015, was got filed by him without vetting from the office of Advocate General, wherein certain wrong facts were mentioned. In fact, the written statement was duly vetted, and a copy of the same has been attached to the petition. It is further contended that the petitioner is going to retire within next six months, and only to harass and humiliate him the charge-sheet has been Ashwani Kumar 2023.12.13 18:04 I attest to the accuracy and integrity of this document

Learned State counsel, appearing on advance notice, submits that the petition is pre-mature and even reply to the charge-sheet has not been filed so far. In case the reply is filed, final decision on the chargesheet will be taken by the respondents within three months therefrom. 4.

In view of the statement made by learned State counsel, learned counsel for the petitioner has no objection to the petition being disposed of in terms thereof.
