MANJARI NEHRU KAUL, J. (Oral) Prayer in this petition is for grant of anticipatory bail to the petitioner in FIR No. 269 dated 20.11.2019 under Section 306 IPC registered at Police Station Nathana, District Bathinda. The FIR in question was registered at the instance of the father of the deceased wherein it was alleged that his deceased daughter remained upset on account of the illicit relations of her husband i.e. petitioner herein and she would be subjected to mental harassment by the petitioner on the said count and despite being asked by the complainant as well as his deceased daughter, the petitioner refused to mend his ways. Hence, the mental harassment which the deceased was subjected to, by the petitioner, drove her to end her life.
The learned counsel for the petitioner has submitted that the RUPINDER KAUR 2020.02.05 16:11 I attest to the accuracy and integrity of this document petitioner is totally innocent and it is after 15 years of the marriage that the
CRM-M-54704-2019 [ 2 ] deceased committed suicide which was not on account of any illicit relations which the petitioner allegedly had with another woman but due to the fact that the deceased was suffering from depression. I have heard the learned counsel and have gone through the record.
Keeping in view the facts of the case, I do not find any ground to grant anticipatory bail to the petitioner. The petition is accordingly dismissed.
However, any observations made here-in-above shall not be construed to be a reflection on merits of the case and shall have no bearing on the trial.
