The present revision petition has been filed under Article 227 of the Constitution of India for issuance of a direction to the Family Court, Rupnagar to decide the petition being HMA/2/2022 filed under Section 13 of the Hindu Marriage Act, 1955 within six months. 2.

The dashboard of the Family Court, Rupnagar, available on the website of National Judicial Data Grid, reveals that 739 such cases are pending including 5 to 8 years old cases.

Hon'ble Supreme Court in the case titled as High Court Bar Association, Allahabad Vs. State of U.P. & Ors. [2024 (2) RCR (Civil) 199] has held in para No.37(c) as under :

"37(c) Constitutional Courts, in the ordinary course, should refrain from fixing a time-bound schedule for the disposal of cases pending before any other Courts. Constitutional Courts may issue directions for the timebound disposal of cases only in exceptional JITENDER KUMAR 2024.11.16 08:25 I attest to the accuracy and authenticity of this order/judgment.

No exceptional circumstances have been shown to this Court for issuance of directions to the Family Court concerned for a time bound decision of the petition filed by the petitioner under Section 13 of the Hindu Marriage Act, 1955. The present revision petition is accordingly dismissed. Pending applications, if any, also stand disposed off.
