The prayer in this petition under Section 483 BNSS, 2023 is for the grant of the regular bail to the petitioner in FIR No.82 dated 10.03.2023 (Annexure P-1) under Section 302 of the IPC and Section 25 of Arms Act registered at Police Station Butana, District Karnal, Haryana. 2.

The learned Amicus Curiae appearing on behalf of the petitioner contends that the allegations levelled against the petitioner and his co-accused are baseless. There is no cogent evidence inculpating the petitioner with the commission of the offence. The knife used in the occurrence has been sent for forensic analysis, the result of which is still awaited. As the petitioner is in custody since March, 2023 but only one of the 21 prosecution witnesses has been examined so far, the trial of the present case is not likely to be concluded anytime soon and therefore, he is entitled to the concession of bail.

The learned State counsel, on the other hand, contends that the petitioner is the main accused. There are specific allegations levelled against him that he gave knife blows on the chest and stomach of the deceased. Therefore, he is not entitled to the concession of bail as prayed for.

I have heard learned counsel for the parties. 5.

As per the case of the prosecution version, the petitioner is the main accused having given injuries with a knife on the person of the deceased, which proved to be fatal. Therefore, at this stage, he does not deserve the concession of bail. Hence, the present petition stands dismissed, at this stage.

All the pending miscellaneous applications, if any, stand disposed of.
