Advocate General, Haryana. **** SHEEL NAGU, CHIEF JUSTICE (Oral) The petitioner prays for grant of regular bail in case FIR No. 552 dated 31.12.2021 under Sections 420, 406, 506 read with Section 34 of the Indian Penal Code (Section 201 IPC added later on) registered at Police Station Sonipat Sadar, District Sonipat.

The petitioner is in custody for the commission of offences of cheating and forgery etc. and is facing trial where four prosecution witnesses have been examined but the complainant has not come forward despite issuing of summons and bailable warrants.

Considering the fact that the petitioner was alleged with the offence of duping the complainant of Rs. 8.73 lacs from the complainant by giving him a false promise of obtaining public employment in Railway but the said promise was not fulfilled and the fact that there is one more case registered against the petitioner, this Court is of the considered view that one opportunity be granted to the prosecution to examine the complainant again failing which the petitioner can approach this Court again. 4.

Accordingly, the petition stands dismissed with the aforesaid liberty.
